SFC's Latest Consultation Paper on Sentencing and Related Matters in the Review of Sexual Offences
The Law Reform Commission on 12 November 2020 published a consultation paper making proposals for the reform of law in relation to sentencing and related matters in the review of sexual offences. The consultation paper includes proposals for penalties (i) for two existing offences in the Crimes Ordinance:
(i) for two existing offences in the Crimes Ordinance: (a) rape be renamed as ‘sexual penetration without consent’; and
(b) incest in the Crimes Ordinance;
(ii) proposed 30 new offences (e.g. causing a person to engage in sexual activity without consent, sexual exposure, voyeurism and non-consensual upskirt-photography).
The consultation paper contains proposal for treatment and rehabilitation of sex offenders at various stages, as well as introduces sexual conviction record check scheme. The consultation closes on 11 February 2021. The proposals in the Consultation will have a significant impact on the existing laws of Hong Kong. In that context, allowing a protracted period for consultation and implementation seems advisable as there will be a fair degree of education required before the relevant legislation become effective.
