Reciprocal enforcement of Mainland and Hong Kong judgements in civil and commercial matters

The Mainland Judgements in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (Cap. 645) (the “Ordinance”) is set to come into effect on January 29, 2024. 

On 25 January 2024, the Hong Kong Judiciary promulgated a new Practice Direction 38 – “Reciprocal Enforcement of Mainland and Hong Kong Judgments in Civil and Commercial Matters” to govern the practice and procedure for the registration of Mainland judgments in Hong Kong and the application for certified copies of Hong Kong judgments and Registrar’s Certificates for recognition and enforcement in the Mainland under the Ordinance and its rules.

The Practice Direction will come into effect on 29 January 2024.

Please note that judgments in a series of civil and commercial matters, such as those pertaining to personal relations, succession, bankruptcy, voter qualification, validity of arbitration agreements, and the recognition of arbitration awards would be regulated by other pertinent guiding documents.
